BOARD OF ZONING APPEALS
SPECIAL CALLED MEETING - 10:00 A.M. ? NOVEMBER 23, 2004
The Special Called Meeting of the Board of Zoning Appeals was held Tuesday,
November 23, 2004 at 10:00 A.M., on the 1st Floor of the Government Center
Annex, 420-10th Street. Members present were:

Mr. Ralph King
Mr. Billy Edwards
Also present were Mr. Danny Cargill, Secretary of the Board, and Ms. Veronica
Pitts, Recording Secretary.
VARIANCE.
Case No. 04-V164?-Granted.
Bill Caudill, Senior Vice President of Phillips Construction and Thomas
Kendrick of Kendrick Realty, presented the appeal of Phillips Construction
Company, 324 Brown Avenue, for a variance to reduce the front yard setback
requirement from 20 feet to 5 feet, in order to erect a commercial building,
40? x 50?. The property is zoned C-3.
The variance needs to be amended to also address reducing the required number
of off-street parking from 1 to 0.
In their statements and in response to questions from the Board Members, Mr.
Caudill and Mr. Kendrick gave the following information: The building was
damaged by a windstorm and the roof collapsed. When the building was taken
down, two corners of the building were left standing and the existing slab.
They would like to erect a metal building warehouse for Kendrick Realty

Company. The existing building is on the property line. If they slide the
building back to meet the current zoning which would be 20 feet back, the
building gets real close to the back property line, which has different
elevations. The adjacent property slopes from Andrews Road back about 15 or 16
feet and it would cause a hardship if a deep retaining wall was built to hold
that building up. They are asking to come within 5 feet of the property line
to gain access through the front. They are also asking to reduce the parking
from 1 to 0.
When the Chairperson asked for opposition, Herbert Highnote came
forward. He owns the adjacent property and wanted to know what was being
done. He was not in opposition.
Mr. Edwards made a motion, which was seconded by Mr. Lewis to grant
this appeal because the building will be on an existing slab and the topography
dictates that it needs to be closer to the road. Also, reduce the parking from
1 to 0. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
