AN ORDINANCE

An ordinance amending Columbus Code Section 11-18 so as to require permits for

the sale of nonexplosive sparklers and other items legalized by O.C.G.A.

Section 25-10-1; requiring a payment of an annual $100.00 permit fee to the

Fire Prevention Division; and for other purposes.

THE COUNCIL OF COLUMBUS, GEORGIA HEREBY ORDAINS:



SECTION 1.



Section 11-18 of the Columbus Code is hereby amended by adding a new subsection

(d) to read as follows:



?(d)(1) For the storage, sale or handling of wire or wood sparklers of not more

than 100 grams of mixture per item; other sparkling items which are

nonexplosive and nonaerial and contain 75 grams or less of chemical compound

per tube or a total of 200 grams or less for multiple tubes; snake and glow

worms; trick noise makers which include paper streamers, party poppers, string

poppers, snappers and drop pops each consisting of 0.25 grains or less of

explosive mixture, a permit shall be applied for at the Fire Prevention

Division. An annual permit fee of $100.00 shall be paid to the Fire Prevention

Division upon application.



(2) The Chief or his designee in the Fire Prevention Division shall act upon

the application for permit within 30 days of submission and if no action is

taken by the Chief or his designee within 30 days of submission, the

application shall be deemed approved. Permits shall be kept on the premises of

any permanent structure where items listed in subsection (d)(1) are stored,

sold or handled. For vendors not located in a permanent structure, permits

shall be kept on the person conducting sales of items listed in subsection

(d)(1).



(3) Any person violating any provision of this subsection (d) shall be punished

as provided in Section 1-8 of the Columbus Code.

SECTION 2.



All ordinances or parts of ordinances in conflict with this ordinance are

hereby repealed.
