AN ORDINANCE
NO.
An Ordinance amending the Zoning Atlas of the Consolidated Government
of Columbus, Georgia; this amendment changes certain boundaries of a district
located at 1741, 1729, 1721, 1715, 1711, 1707, and 1703 Elvan Avenue, from R-2
(Low Density Residential) District to R-4 (High Density Residential) District.
THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:
That the Zoning Atlas on file with the Planning Division of the
Department of Community and Economic Development be, and the same is hereby
amended by changing the following described property from R-2 (Low Density
Residential) District to R-4 (High Density Residential) District:
That certain lot or parcel of land located, lying and being in Muscogee County,
Georgia, and being in a Subdivision known as ?Esquiline Valley? and being part
of Lot Twenty-five (25) Block ?A?, Esquiline Valley as shown by a map thereof
appearing of record in the Office of the Clerk of the Superior Court of
Muscogee County, Georgia, in Plat Book 8, Folio 12 and 13 and being more
particularly described as follows:
BEGINNING at the northwest corner of Elvan Avenue and Marathon Drive and
running along the northern right-of-way of Marathon Drive, a distance of 125
feet, more or less, to an iron pin; thence along a fence running in a northerly
direction along said fence, a distance of 87.2 feet, more or less, to an iron
pin; thence running in a southeasterly direction a distance of 151.7 feet, more
or less, to a point on the west right-of-way on Elvan Avenue; thence running in
a southerly direction along the west right-of-way of Elvan Avenue a distance of
82 feet, more or less, to an iron pin at the point of beginning.
And
All those lots, tracts and parcels of land situate, lying and being in the
State of Georgia, County of Muscogee, in the 7th Land District of said County,
and in the City of Columbus, and being known and designated as ALL OF LOTS
NUMBERED TWENTY-TWO (22), and TWENTY-THREE (23), in BLOCK LETTERED ?A?, of
ESQUILINE VALLEY SUBDIVISION, as shown on a map or plat of said subdivision
recorded in Plat Book 1, Page 58, in the Office of the Clerk of the Superior
Court of Muscogee County, Georgia.
And
COMMENCING at an iron stake on the northwesterly margin of Elvan Avenue located
262 feet northeasterly (measuring along said northwesterly margin of Elvan
Avenue) from the intersection of the northwesterly margin of Elvan Avenue and
the northeasterly margin of Marathon Drive(which beginning point is also the
easterly most corner of Lot 22 of said Block ?A?); thence North 62 degrees 28
minutes West and along the northeasterly margin of said Lot 22, a distance of
430.96 feet to an iron stake located on the southeasterly margin of the F.
Marion Levy Survey; thence North 28 degrees 29 minutes East and along the
southeasterly margin of said F. Marion Levy Survey, a distance of 122 feet to
an iron stake located at the westerly most corner of Lot 19 of said Block ?A?;
thence South 62 degrees 28 minutes East and along the southwesterly margin of
said Lot 19, a distance of 420.45 feet to an iron stake located on the
northwesterly margin of Elvan Avenue; thence South 23 degrees 26 minutes West
and along the northwesterly margin of Elvan Avenue, a distance of 120 feet to
the point of beginning.
And
All that lot, tract and parcel of land situate, lying and being in the State of
Georgia, County of Muscogee and City of Columbus and being known and designated
as ALL OF LOT NUMBERED NINETEEN (19), in BLOCK LETTERED ?A?, ESQUILINE VALLEY,
as said lot is shown upon a map or plat of said Subdivision recorded in Plat
Book 1, Folio 58, in the Office of the Clerk of the Superior Court of Muscogee
County, Georgia.
And
All that lot, tract and parcel of land situate, lying and being in the State of
Georgia, County of Muscogee and City of Columbus and being known and designated
as ALL OF LOT NUMBERED EIGHTEEN (18), in BLOCK LETTERED ?A?, ESQUILINE VALLEY,
as shown on a map or plat of said Subdivision dated June 8, 1938, made by E.B.
Respess, C.E., and recorded in Plat Book 1, Folio 58, in the Office of the
Clerk of the Superior Court of Muscogee County, Georgia, to which reference is
hereby made for a more particular description and location of said lot.
And
All that lot, tract and parcel of land situate, lying and being in the Seventh
District of said State and County, and in Muscogee County, Georgia, and known
and designated as LOT NO. 17, of BLOCK ?A?, of a subdivision known as ESQUILINE
VALLEY, a map or plan of which Subdivision was made by E.B. Respess, C.E., and
which map or plan is recorded in the Office of the Clerk of the Superior Court,
said State and County, in Plat Book 1, Folio 58. Said lot No. 17 hereby
conveyed fronts East 60 feet on Elvan Avenue, has a North line of 425 feet, a
South line of 427 feet and a rear or West line of 61 feet.
And
All that lot, tract and parcel of land situate, lying and being in the State of
Georgia, County of Muscogee and City of Columbus and being known and designated
as ALL OF LOT NUMBERED SIXTEEN (16), in BLOCK LETTERED ?A?, of that certain
Subdivision of land known as ESQUILINE VALLEY SUBDIVISION, as said lot appears
on a map or plat of said subdivision, recorded in the Office of the Clerk of
the Superior Court of Muscogee County, Georgia in Plat Book 1, Folio 58.
The above-described property is being rezoned with the following conditions:
1. All lighting shall be directed internally using deflectors.
2. No external trash dumpsters / compactors shall be located along the property
line bordered by the R-2 zoning district
