REGULAR MEETING - 2:00 P.M. ? JUNE 2, 2004
The Regular Meeting of the Board of Zoning Appeals was held Wednesday, June 2,
2004 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:
Mr. David Fox

Mr. Ralph King
Also present were Mr. Danny Cargill, Secretary of the Board, and Ms. Veronica
Pitts, Recording Secretary.
Board Member Leah Braxton was unable to attend the meeting. Mr. King
made a motion, which was seconded by Mr. Lewis, to excuse Ms. Braxton?s absence
on today, June 2, 2004, for personal reasons. Motion carried unanimously by the
four Board Members present for this meeting.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to approve
the Minutes of the Monthly Meeting, which was held on May 5, 2004. Motion
carried unanimously by the four Board Members present for this meeting.

Case No. 04-HO114--Denied.
There was no one present to present the application of Brandon Wallis, 2419
Coventry Drive, for a Certificate of Occupancy for a Home Occupation for an
office only for a locksmith business, A-Locksmith Company. The property is
zoned R-2.
There was no opposition to this application.
Mr. Edwards made a motion, which was seconded by Mr. Lewis,
to deny this application because there was no one present to
present the application for two consecutive meetings. Motion
carried by the affirmative vote of the four Board Members present
for this meeting.

Darryl Huff, 2511 Warm Springs Road, presented her application for a
Certificate of Occupancy for a Home Occupation for an office only for a lawn
care service, Huff Lawn Care. The property is zoned R-2.
In his statement and in response to questions from the Board Members, the
applicant gave the following information: He will be using one room in his
home as an office only. He will have no employees and there will be no
additional traffic in the neighborhood. This will be part time
work.

Mark Sizemore and Gerald Park of Southern Awning, presented the appeal of Jim
Netherow, 4706 Sequoia Drive, for a variance to reduce the side yard setback
requirement from 8 feet to 4 feet, in order to make an addition, 22? x 24?, a
carport, to a single family residence. The property is zoned R-2.
In their statements and in response to questions from the Board
Members, Mr. Sizemore and Mr. Park gave the following information: Mr.
Netherow would like to install a carport on the side of his house. The carport
will be over an existing pad. It will extend 5 feet past the house to cover
the house and will come up to the first window. It will have gutters and the
water will flow to the street.
There was no opposition presented to this appeal.

this appeal because the carport will be over an existing slab and the water

In their statements and in response to questions from the Board
Members, Mr. Sizemore and Mr. Park gave the following information: Mr. Turk
would like to add a carport to his home. It will be 11 feet with the pans and
an extra 3 feet if gutters are added. He has a privacy fence and his neighbor
has a fence. He would like to put the post on the outside of the slab if he
could, but he will put it on the slab if he has to. The water will go to the

Gary Self presented the appeal for his mother, Lotte Self, 204 Bob-O-Link
Drive, for a variance to reduce the side yard setback requirement from 8 feet
to 3 feet, in order to make an addition, 5? x 9? 6?, a bathroom, to a single
family residence. The property is zoned R-1A.
In his statement and in response to questions from the Board Members, Mr. Self
gave the following information: His mother is 78 years old. They would like to
put in a ? bath on that side because she may not be able to step in the tub and
they would like to put a shower in. The water will flow to the front and rear,
it should not change the water flow. It will have a hip roof. There is a
flower bed that will direct the water so it will not go to the neighbors yard.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to grant this appeal
because this will be in sync with the rest of the house and there was no
opposition. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 04-V62?-Tabled.
There was no one present to present the appeal of Aletha Paschal, 1020 Watson
Drive, for a variance to reduce the rear yard setback requirement from 30 feet
to 26 feet, in order to make an addition, 12? x 16?, a den, to a single family
residence. The property is zoned R-1A.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to table this appeal
until the July meeting because there was no one present to present the appeal.
Motion carried by the affirmative vote of the four Board Members present for
this meeting.
Case No. 04-V63?-Granted.
Ben Moon presented the appeal of Jose Pinott, 3823-B Meritas Drive, for a
variance to reduce the front yard setback requirement from 20 feet to 14 feet 8
inches and to reduce both side yard setback requirements from 8 feet to 2 feet
9 inches and to 2 feet 7 inches, in order to subdivide a lot. The property is
zoned R-3A.
In his statement and in response to questions from the Board Members, Mr. Moon
gave the following information: These are two houses that were grand-fathered
in and they have been there for several years there was a third house on the
lot and it has been removed. He wants to divide it in order to finance it
separately. They want to be able to separate them so they can do something with
them individually rather than collectively.
Planning recommends approval of this request. The memorandum from
Aronda Smith, Principal Planner, Planning Division, is attached and therefore
is considered a part of these minutes.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant
this appeal because this will clean up the deeds for these two homes, otherwise
they will have to sell the property with two homes on the lot. Motion carried
by the affirmative vote of the four Board Members present for this meeting.
Case No. 04-V64?-Granted.
Ben Moon presented the appeal of Jose Pinott, 3823-A Meritas Drive, for a
variance to reduce the front yard setback requirement from 20 feet to 16 feet 2
inches and to reduce the side yard setback requirement from 8 feet to 2 feet 7
inches, in order to subdivide a lot. The property is zoned R-3A.
In his statement and in response to questions from the Board Members, Mr. Moon

Richard Catrett, 1231-B Linwood Boulevard, presented his appeal for a variance
to reduce the corner side yard setback requirement from 20 feet to 4 feet, in
order to erect a restaurant, 10? x 40?. The property is zoned C-3.
In his statement and in response to questions from the Board Members,
Mr. Catrett gave the following information: He would like to build a portable
hot dog stand. He would like to get with his partner and franchise the hot dog
stand in the southeast. He thinks this would be a good start and a convenient
location. The Medical Center and Salvation Army are expanding and may go near
this area.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to deny this
appeal because this is a trailer type building and not the building of a new
restaurant. Motion carried by a vote of 4 to 1 with Billy Edwards voting
against the motion.
Case No. 04-V66?-Granted.
Edwin Kimbrough, 2410 York Court, presented his appeal for a variance to reduce
the rear yard setback requirement from 30 feet to 22 feet, in order to make an
addition, 14? x 20?, a sunroom, to a single family residence. The property is
zoned R-2.
In his statement and in response to questions from the Board Members,
Mr. Kimbrough gave the following information: He would like to add a sunroom
to his home. The same materials will be used to match the house. The water
will flow from to the front and back, there is a drain the water will go to.
It will have a gable roof and the matching shingles. This is an odd shaped
lot.

Mr. King made a motion, which was seconded by Mr. Lewis, to grant this
appeal because the same materials will be used to match the house and there was
no opposition to this appeal. Motion carried by the affirmative vote of the
four Board Members present for this meeting.
Case No. 04-V67?-Granted.
Oscar Romine, 1274 Canaan Court, presented his appeal for a variance to reduce
the side and rear yard setback requirements for an accessory structure from 5
feet to 2 feet 6 inches. The property is zoned R-1A.
In his statement and in response to questions from the Board Members, Mr.
Romine gave the following information: He is building a storage shed in the
very back of his property and there is an indent on the property for the shed
to sit into. It is in the middle of the cul-de-sac, it will not be close to
any housing area. It will have a gable roof and the same shingles and paint
will be used to match the house. The property slopes to the back, the water
will drain to the back.

Mr. King made a motion, which was seconded by Mr. Lewis, to grant this appeal
to build an accessory structure, the same materials will be used to match the
house. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 04-V68--Granted.
Vernon Olds, Builder, presented the appeal of Larry Sanders, 2221 Hilton
Avenue, from a Decision of the Building Official that an accessory structure is
not allowed in the front yard. The property is zoned R-1A.
In his statement and in response to questions from the Board Members,
Mr. Olds gave the following information: Mr. Sanders would like to build a
carport over an existing slab in the front yard. He would like closer access
to his front door, this is the main egress to his house. It will be four
columns and open on all 4 sides. It will be approximately 150 feet from the
road.

Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant
this appeal, although the Building Official is correct that an accessory
structure is not allowed in the front yard, this is an odd shape lot, the
accessory structure will be far from the road and it will be over an existing
pad. Motion carried by the affirmative vote of the four Board Members present
for this meeting.
Case No. 04-V69?-Granted.
Denise Ervin, 2701 4th Avenue, presented her appeal for a variance to reduce
the side yard setback requirement from 8 feet to 6 inches, in order to make an
addition, 10? x 24?, a carport, to a single family residence. The property is
zoned R-3A.
In her statement and in response to questions from the Board Members,
Ms. Ervin gave the following information: She would like to add a carport to
her home to protect her car from the sun and from the sap from the trees. This
will be easy access to the side door to enter the house when it rains. This
will also increase the value of her home. She does not have gutters, but she
will if needed.

Mr. King made a motion, which was seconded by Mr. Edwards, to grant
this appeal to add a carport with the stipulation that gutters must be added.

Case No. 04-V70?-Granted.
Archie Parks, 6601 Standing Boy Road, presented his appeal from a Decision of
the Building Official that an accessory structure is not allowed in the side
yard. The property is zoned A-1.
In his statement and in response to questions from the Board Members, Mr. Parks
gave the following information: He was told that a swimming pool has to be
totally behind your house. He has an addition to his house and it was designed
to have the pool where it is shown on the site plan. Part of the pool is
recessed back into the off set of the house and part of it is behind the
house. His house is approximately 350-400 feet from the road.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this
appeal, although the Building Official is correct that an accessory structure
is not allowed in the side yard, part of the accessory structure is in the back
of the house and part of it sticks out into the side yard. They added on the
house and the addition wraps around the pool, this is an odd shaped lot and it
will be approximately 300-400 feet from the road. Motion carried by the
affirmative vote of the four Board Members present for this meeting.
Case No. 04-V71--Granted.
Gail Aderhold, Action Buildings, presented the appeal of John Epps, 6344
Fitzgerald Drive, for a variance to reduce the side yard setback requirement
from 8 feet to 6 feet, in order to make an addition, 12? x 30?, a carport, to a
single family residence. The property is zoned R-2.
In her statement and in response to questions from the Board Members,
Mr. Aderhold gave the following information: Mr. Epps would like to add a
carport to his home that will be over an existing slab. This will be a
standard steel structure. There are similar carports in the neighborhood. The
water will flow to street to the gutter.

Mr. King made a motion, which was seconded by Mr. Lewis, to grant this
appeal because the carport will be over an existing slab, there will not be any
water flow problems and there was no opposition. Motion carried by the
affirmative vote of the four Board Members present for this meeting.
Case No. 04-V72?-Granted.
Robert Teasley, Signs Inc., and Mike Lusk of Kelloggs,, 3700 Victory Drive,
presented the appeal for a variance to increase the number of signs that are
allowed from 2 to 3. The property is zoned M-1.
In their statements and in response to questions from the Board
Members, Mr. Teasley and Mr. Lusk gave the following information: They would
like to request a variance on the number of sign they can have on their 17 acre
property. The signs total about 60 square feet for any other size lot they
would be entitled to 300 square feet. They have approximately 350 employees.
They have two signs, one is approximately 4? x 8? that identifies that it is
Kellogg?s and the other one is an entrance sign for employee parking. The
additional sign (that is shown on the fence) they are asking for is designed
for the semi trucks to park into, so they won?t turn into the employee
parking. The sign will not be on the fence, it will be on a pole.

Mr. King made a motion, which was seconded by Mr. Lewis, to grant this
appeal so that they can get their trucks directed in and out properly. (The
sign will be put on a pole and not on a fence). The size of the property is so
large that even with this sign added it would still be well under the total
square footage that they will be permitted in signage. Motion carried by the
affirmative vote of the four Board Members present for this meeting.
Case No. 04-V73?-Granted.
Robert Teasley, Signs Inc, presented the appeal of Waddell Elementary School,
6101 Miller Road, for a variance to reduce the front yard setback requirement
from 10 feet to 3 feet and to increase the size of a sign from 15 square feet
to 40 square feet. The property is zoned R-1A.
In his statement and in response to questions from the Board Members, Mr.
Teasley gave the following information: Most of the schools are getting these
type of two sided signs. The existing sign will come down and they will put up
a new one in the exact location. The sign needs to come forward because of the
size of the letters they are trying to keep the size of the sign in harmony
with the neighborhood and height of the letter determines the distance you can
read it from the road.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. King, to grant this
appeal, they will remove the existing sign and put up a new one in the exact
same place. These type of signs have been approved at schools in the past.
This will be a two sided sign. Motion carried by the affirmative vote of the
four Board Members present for this meeting.
Case No. 04-V74--Granted.
David Fox presented the appeal of Pinnacle Homes, Inc., 8039 Sonoma Pointe
Drive, for a variance to reduce both side yard setback requirements from 8 feet
to 5 feet and to reduce the rear yard setback requirement from 30 feet to 28
feet, in order to erect a single family residence, 43? 6? x 63? 5?. The
property is zoned R-2.
In his statement and in response to questions from the Board Members,
Mr. Fox gave the following information: In Sonoma Pointe all the lots are 60
feet and occasionally when you have an arc where the road turns you may have a
lot pinched down. All of the plans are very similar and this is the first part
of Sonoma Pointe. Along the main stretch there are no trees and a long alley
way and they are setting the houses back 38 to 40 feet from the actual curb,
but 28 to 30 feet back from the property line. Because of the way the plans
are designed this particular lot pinches down to 48 feet in the back, although
it has 71 feet in the front, regardless of what plans are used a variance is
required for this lot. This is a larger plan, but even the smaller plans would
require a variance.

this appeal because this is an odd shaped lot and this will allow the house to
be placed on the lot and it will be in sync with the subdivision. Motion
carried by the affirmative vote of the three Board Members with David Fox
abstaining from the vote.

driveway at one time. She will have 5 weekly clients, 2 on Thursday morning, 2
on Friday morning and 1 on Saturday.
When the Chairperson asked for opposition Alice Townsend and Doug & Susie Rebel
came forward. There were also letters from Rosemary Baker, Susan McCamy and
Robert Unwin. They want their neighborhood to remain residential, they don?t
want a business there, there are no other exits and they are concerned with
traffic, safety and decreasing property value.
Mr. Edwards made a motion, which was seconded by Mr. King, to deny this
application because there was opposition and there were concerns with traffic.
