I look forward to appearing at council at 9am on 12-13-05.
The nature of my business is to receive the answers to our questions posed
at the 8/16/05 meeting, which are:
1) Why did the City of Columbus not enforce the Columbus
Noise Ordinance on 911 complaints due to P&W JETC noise?
REMEMBER THAT MY REAL ESTATE AGENTS STATED THEY COULD NOT LIVE IN THERE
DUE TO THE NOISE, AND THREE POLICE OFFICERS FOUND THE NOISE TO BE
UNREASONABLE AND A FOURTH OFFICER STATED HE UNDERSTOOD HOW THERE MAY BE
SOME DISCOMFORT.
2) Why did the Columbus Police Department arrive at our home on 911
noise complaints without a decibel meter for four years?
3) Why did the City of Columbus fail to do any of the required yearly
reviews of the Columbus Noise Ordinance for twelve years?
4) Why did the City of Columbus not enforce the Noise Ordinance
nighttime limit of 70 dbA at our home? While on a noise complaint, I
mentioned to a Police Officer, ?and they (P&W) went over 70 tonight?? The
Police Officer stated while looking at my decibel meters ?73, 74, yeah??
5) Why was our home designated as ?COMMERCIAL? property for purposes
of the Noise Ordinance. When I asked on Officer if my home looked like
commercial property, he replied stating ?Well, this is a residence.?
6) Why was the Noise Ordinance not enforced at our home where it was
exceeded for five years, but enforced elsewhere in Muscogee County 55
times per two months ?
An Officer at our home said ??find out just what, you know, the noise
ordinance reads, and if they are in violation, then I guess somebody needs
to do something."
7) Why was the GA Open Records Act violated at least three times when
records were requested from the City?
8) Why were the Noise Ordinance nighttime limits raised by the City
to exceed all limits recommended by the Federal Aviation Administration,
the U.S. Environmental Protection Agency, the World Health Organization,
and the Acoustical Society of America?
9) Why was Pratt & Whitney allowed to test themselves for noise?
A North Precinct Officer said that ?Pratt and Whitney has tested
themselves and are within the limits.?
Councilor Woodson and Mayor Poydascheff agreed publicly 8/16/05
that they would provide answers to all of my questions at open council to
assure the public that they are not ignoring me nor hiding anything.
Ironocally, it has been nearly 4 months and I have received absolutely no
response from ANYONE regarding this situation, and I expect either answers
or a public commitment of a specific date and time when answers will be
provided to me and the citizens of Columbus. Thank you.
