An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located along the northern boundary of the A-O section of Columbus Park

Crossing, from C-3 (General Commercial) District to A-O (Apartment-Office)

District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from C-3 (General

Commercial) District to A-O (Apartment-Office) District:



All that tract or parcel of land lying and being in Land Lot 39 of the 8th

District of the City of Columbus, Muscogee County, Georgia, being more

particularly described as follows:

Commence at a 3/4" crimped top pipe marking the common corner of Land Lots 22,

23, 38, and 39, said pipe being the POINT OF BEGINNING; thence along the

southerly line of said Land Lot 39, North 89 degrees 48 minutes 53 seconds West

for a distance of 508.49 feet to a point; thence North 00 degrees 00 minutes 00

seconds West for a distance of 49.79 feet to a point on the southerly

right-of-way line of Whittlesey Parkway (having a variable right-of-way);

thence along said southerly right-of-way line the following courses and

distances: thence North 90 degrees 00 minutes 00 seconds East for a distance of

158.50 feet to a point; thence along a curve to the left having a radius of

811.00 feet and an arc length of 305.01 feet, being subtended by a chord of

North 79 degrees 13 minutes 33 seconds East for a distance of 303.21 feet to a

point; thence leaving said southerly right-of-way line, South 25 degrees 44

minutes 17 seconds East for a distance of 120.03 feet to the POINT OF

BEGINNING.

And

All that tract or parcel of land lying and being in Land Lot 39 of the 8th

District of the City of Columbus, Muscogee County, Georgia, being more

particularly described as follows:

Commence at a 3/4" crimped top pipe marking the common corner of Land Lots 22,

23, 38, and 39;

thence along the southerly line of said Land Lot 39, North 89 degrees 48

minutes 53 seconds West for a distance of 508.49 feet to the POINT OF

BEGINNING; thence North 89 degrees 48 minutes 53 seconds West for a distance of

60.00 feet to a point; thence North 00 degrees 00 minutes 00 seconds West for a

distance of 49.60 feet to a point on the southerly right-of-way line of

Whittlesey Parkway (having a variable right-of-way); thence along said

southerly right-of-way line, North 90 degrees 00 minutes 00 seconds East for a

distance of 60.00 feet to a point; thence South 00 degrees 00 minutes 00

seconds East for a distance of 49.79 feet to the POINT OF BEGINNING.

And

All that tract or parcel of land lying and being in Land Lot 38 of the 8th

District of the City of Columbus, Muscogee County, Georgia, being more

particularly described as follows:

Commence at a 3/4" crimped top pipe marking the common corner of Land Lots 22,

23, 38, and 39, said pipe being the POINT OF BEGINNING; thence along the

easterly line of said Land Lot 38, South 00 degrees 47 minutes 29 seconds West

for a distance of 2.81 feet to a point; thence South 89 degrees 44 minutes 40

seconds West for a distance of 41.57 feet to a point; thence South 61 degrees

27 minutes 36 seconds West for a distance of 278.51 feet to a point; thence

along a curve to the left having a radius of 2600.00 feet and an arc length of

260.48 feet, being subtended by a chord of South 58 degrees 35 minutes 23

seconds West for a distance of 260.37 feet to a point; thence North 00 degrees

00 minutes 00 seconds West for a distance of 273.40 feet to a point on the

northerly line of said Land Lot 38;

thence along said northerly land lot line, South 89 degrees 48 minutes 53

seconds East for a distance of 508.49 feet to the POINT OF BEGINNING.



The above-described property is being rezoned with the following conditions:



1. All lighting shall be directed internally using deflectors.

2. No access shall be permitted to / from Oberlin Drive or Cinnamon Loop.

3. No direct access shall be permitted to Weems Road.

4. No site development permits shall be issued for the tract, except for

transportation improvements, until a site plan for the tract is reviewed for

compliance with Code requirements by the Department of Community and Economic

Development.

5. The developer shall be responsible for constructing a third lane along the

length of the property fronting the proposed Whittlesey Road extension.

6. The foregoing conditions shall be permanent.

7. If the property is not used as multi-family residential within two (2) years

of the adoption of this ordinance, then the property shall revert back to the

C-3 (General Commercial) zoning district.
