AN ORDINANCE

An Ordinance amending the Zoning Atlas of the Consolidated Government
of Columbus, Georgia; this amendment changes certain boundaries of a district
located at 2100 Hilton Avenue and 2500 Woodcrest Drive, from R-1A (Low Density
Residential) District to R-3 (Medium Density Residential) District.
THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:
That the Zoning Atlas on file with the Planning Division of the
Department of Community and Economic Development be, and the same is hereby
amended by changing the following described property from R-1A (Low Density
Residential) District to R-3 (Medium Density Residential) District:
All that lot, tract or parcel of land situate, lying and being in the City of
Columbus, Muscogee County, Georgia, and in Land Lot 75 of the Coweta Reserve of
said County, which is more particularly described as follows:
Beginning at an iron pin at the northeast corner of the intersection of Hilton
Avenue and Woodcrest Drive; thence extending northerly along the curve of the
easterly line of Hilton Avenue, a distance of 177.84 feet to an iron pin at the
southwest corner of Lot 1 in Block lettered ?A? of Averett Woods Subdivision,
as said Lot 1 appears on a map or plat recorded in Plat Book 20, Page 76, in
the Office of the Clerk of the Superior Court of Muscogee County, Georgia;
thence extending North 86 degrees 14 minutes East along the southerly line of
Block lettered ?A? of said Averett Woods Subdivision, a distance of 352.82 feet
to an iron pin; thence running South 02 degrees 57 minutes East a distance of
150.13 feet to an iron pin in the northerly line of Woodcrest Drive; thence
running South 82 degrees 25 minutes West along the northerly line of Woodcrest
Drive, a distance of 379.48 feet to the point of beginning.
And
All that certain tract or parcel of land situate, lying and being in the City
of Columbus, Muscogee County, Georgia, and in Land Lot 75 and 94 of the Coweta
Reserve of said County, which is more particularly described as follows:
Beginning at a stone situated at the northwest corner of Lot 1, Block K, of
North Wynnton Grove Subdivision, which stone is also the northeast corner of
the tract of land herein conveyed and running thence South 02 degrees 42
minutes East a distance of 839.94 feet to an iron; thence running North 85
degrees 11 minutes West a distance of 101.8 feet to an iron; thence running
North 85 degrees 15 minutes West a distance of 60.2 feet to an iron; thence
running North 84 degrees 32 minutes West a distance of 102.05 feet to an iron;
thence running North 83 degrees 46 minutes West a distance of 208.94 feet to an
iron; thence running North 06 degrees 58 minutes East a distance of 100 feet to
an iron; thence running North 76 degrees 05 minutes West a distance of 150 feet
to an iron; thence running North 07 degrees 28 minutes East a distance of 55.35
feet to an iron; thence running North 00 degrees 35 minutes East a distance of
245.8 feet to an iron situated on the south line of Woodcrest Drive; thence
running North 02 degrees 57 minutes West a distance of 50.16 feet to an iron on
the north side of Woodcrest Drive; thence continuing North 02 degrees 57
minutes West a distance of 150.19 feet to an iron on the south line of Averett
Woods Subdivision, as said Subdivision is shown on a certain plat recorded in
Plat Book 20, Page 76, in the Office of the Clerk of the Superior Court of
Muscogee County, Georgia; thence running North 86 degrees 14 minutes East along
the south line of said Subdivision a distance of 65.79 feet to an iron; thence
running North 84 degrees 19 seconds East along the south line of said
Subdivision, a distance of 189.6 feet to an iron; thence running North 04
degrees 12 minutes East along the south line of said Subdivision a distance of
92.6 feet to an iron; thence running North 81 degrees 50 minutes East along the
south line of said Subdivision a distance of 266.5 feet to an iron; thence
running North 82 degrees 10 minutes East along the south line of said
Subdivision a distance of 40 feet to the stone which is the point of beginning.
The above-described property is being rezoned with the following conditions:
1. All lighting shall be deflected internally using deflector shields.
2. No external trash dumpsters / compactors shall be located along the property
lines bordered by the R-1A zoning district.
3. The properties shall only be used as a church and accessory facilities, a
private school, and / or a day care center.
4. If St. Thomas Episcopal Church ceases to exist on these properties, then the
Planning Division shall rezone the property back to R-1A.
5. Screening for trash dumpsters / compactors, air conditioners, refrigeration
units, and heat pumps shall be required for all development on the property.
6. All six (6) conditions shall be permanent and not subject to any 20 year
time limit nor to any time limit whatsoever; the conditions shall only be
removed by applying for a rezoning to amend the conditions or applying to
rezone the property outright.
