Recommendation
Approve the attached Resolution to execute a deed, for the sale of 5.682 acres \n \n +/- of property located along the west of the inert landfill at 0 River Road \n \n a/k/a tax map 171-013-010, (see letter and survey) in Columbus, Muscogee \n \n County, Georgia.

Background
Graystone, LLC recently bought approximately 28 acres west of the inert

landfill on River Road. The Jenkins family owned the property for more than 75

years. L. M. Biggers was the owner of most of the property in the area and as

portions of the land was sold, it caused the Jenkins property to be

land-locked. The families access to the property was an unpaved road on River

Road. For about 25 years the City of Columbus and the Jenkins maintained the

unpaved road from River Road to the property. The road is now used to provide

access to the inert land fill and said property. The City placed a gate across

the road, to limit access to the property. The past owner did not live on the

property on a permanent basis therefore, they had no problem with the access

provided by the City. Graystone, LLC as the new owners of the property wishes

to develop the property. The City does not want the liability of providing

public access.
Analysis
Each officiating departments has concurred with the sale of the property with

conditions. There was concern that development close to the landfill may have

a future impact. No residential or commercial development would be permitted

before the year 2020 and a 20 ft. buffer of vegetation would be established

along the eastern boundary of the landfill. Graystone, LLC would be allowed to

construct a road across the 5.682 acres +/- to provide access to the 28 acres

they recently bought.
