Recommendation
Approve the attached resolution authorizing the City Manager to execute legal \n \n documentation to clear title to property being exchanged between the City and \n \n the W.C. Bradley Company along Bay Avenue as part of the Riverside Building \n \n project.

Background
The City has been working with the W.C. Bradley Company in the design and

construction of the Riverside Building project that included the relocation of

Bay Avenue between 11th Street and 12th Street. The companion ordinance for

"Bay Avenue - Permanent Street Closure and Relocation" will take care of the

relocation work.
Analysis
The purpose of this resolution is to accomplish the following tasks to clear

title to the affected property and accept deeds to Bay Avenue and a park (see

attached Revised Replat dated June 24, 2004):

1. The City will quitclaim to the W.C. Bradley Company any interest in Parcels

100, 200, 300, 400, and Bay Avenue from 11th Street to 12th Street and the

former right-of-way of Front Avenue from 11th Street to 12th Street.

2. The W.C. Bradley Company will quitclaim to the City any interest in 11th

Street and 12th Street west of Front Avenue and Parcel 600 (extension of 11th

Street).

3. The W.C. Bradley Company will deed the newly relocated Bay Avenue to the

City.

4. The W.C. Bradley Company will provide a Warranty deed to the City for

Parcel 300 which will become a small park.
Financial Considerations
There are no exchange of funds as part of these transactions.
