Approve the attached resolution authorizing an encroachment of a building \n \n facade/cornice into the 3rd Avenue right-of-way for the St. Luke Methodist \n \n Church building renovation located at 1043 - 3rd Avenue.

Background
St. Luke Methodist Church owns the existing building located at 1043 - 3rd

Avenue. The Church is renovating this building to be used as a Middle School.

This building has a zero set back which causes any new construction to encroach

into street right-of-way. The renovation will include creating a second floor

of which a new building facade will extend into the 3rd Avenue right-of-way.
Analysis
The City has allowed minimal facade encroachments into street right-of-way for

building with zero set backs within the Central Business District. Such

encroachments require Council approval since building codes prohibit such

building construction encroachments. The Engineering Department and the

Inspections and Code Department recommend approval of this encroachment

provided that it carries the condition that the encroachment/conflict shall be

removed at no expense to the City should their be a future need for

improvements.
Financial Considerations
There are not any expenses incurred by the City for this encroachment.
