Background
Lowery Creek Subdivision currently consists of sixteen residential lots. The

street and the detention pond lot have been improved and meet the required

specifications for acceptance by the City.
Analysis
A deed has been submitted conveying to the City Ruth Creek Court and the

Detention Pond Lot located in Lowery Creek Subdivision. Description of the

property is as follows: All that tract and parcel of land situate, lying and

being in Columbus, Georgia and comprising of Ruth Creek Court from the existing

right of way in that certain subdivision known as Lowery Creek, as said portion

of said street is shown upon a map or plat of said subdivision recorded in Plat

Book 146, Folio 62 in the Office of the Clerk of the Superior Court of Muscogee

County, Georgia, and to which map or plat reference is hereby made for a more

particular description of the street hereby conveyed. Also all that tract and

parcel of land situate, lying and being in Columbus, Muscogee County, Georgia

and being known and designated as the Detention Pond Lot in that certain

subdivision known as Lowery Creek, as said Detention Pond Lot is shown upon a

map or plat of said subdivision recorded in Plat Book 146 Folio 62 in the

Office of the Clerk of the Superior Court of Muscogee County, Georgia, and to

which map or plat reference is hereby made for a more particular description of

the property hereby conveyed.
Financial Considerations
No City funds are involved until maintenance is assumed after the two-year

warranty expires.

Legal Considerations
In accordance with Section 18-3 of the Columbus Code, all dedicated

right-of-ways must be accepted by written resolution of Council.
Recommendations/ Actions
Approve the Resolution accepting the deed to Ruth Creek Court and the Detention

Pond Lot located in Lowery Creek Subdivision.

















A RESOLUTION

NO.

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DEED TO RUTH CREEK COURT AND THE

DETENTION POND LOT LOCATED IN LOWERY CREEK SUBDIVISION.

WHEREAS, a deed has been conveyed to Columbus, Georgia, Ruth Creek Court and

the Detention Pond Lot located in Lowery Creek Subdivision; and,

WHEREAS, said street and detention pond lot have been improved and meet the

required specifications for acceptance by the City; and,

WHEREAS, the Engineering Department of Columbus, Georgia has inspected said

street and detention pond lot and recommends acceptance of same.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY

RESOLVES AS FOLLOWS:

That certain deed dated the __19th_ day of __June, 2002_ conveying to Columbus,

Georgia, all of Ruth Creek Court and the Detention Pond Lot located in Lowery

Creek Subdivision be and the same is hereby accepted. The Clerk of Council is

hereby authorized to have said deed recorded in the deed records in the Office

of the Clerk of the Superior Court of Muscogee County, Georgia. A copy of said

deed is hereto attached and by this reference made a part of this Resolution.



Introduced at a regular meeting of the Council of Columbus, Georgia, held

the

2nd day of July, 2002, and adopted at said meeting by the affirmative vote of

members of said Council.
