Background
The City is in the process of buying Right of Way for St. Mary's Road Widening

Project (from Buena Vista Road to Robin Road). In the process of acquisition,

the city needs to acquire property from the Hugley's at 3312 St. Mary's Road

(parcel 9). Adjacent to the Hugley's property is a parcel (6r) that we had to

purchase, leaving a remainder that is too small or odd shaped to be

functional. The Hugley's requested the city trade them a portion of said

property for the fair market value of the uneconomic remaining property. We

will subtract the value from the negotiated amount paid to the Hugley's thus

offsetting the right of way cost for the city. Because of the positions that

Mr. and Mrs. Hugley hold, a disclosure document will be filed in the Clerk of

Council Office.
Analysis
Said property is a remainder of property needed for right of way. This action

is supported by the City Charter Sec. 7-501(4).
Financial Considerations
Exchanging the property saves right of way cost and keeps the property on the

Tax Digest.
Projected Annual Fiscal Impact Statement
Legal Considerations
The City Attorney has no objections to this ref: the City Charter 7-501(4).
Recommendations/ Actions
Authorize the City Manager to execute a Quit Claim to of said uneconomic

remainder to Isaiah Hugley,Sr. and Carolyn F. Hugley in exchange for the Fair

Market Value of said uneconomic remaining property, being the difference

between the Fair Market Value of the required right of way of the Hugley

property less the Fair Market Value of the remaining property (parcel 6r) for

0.226 acres of property on St. Mary's Widening Project.
