Recommendation
Approval is requested of a resolution consenting to Columbus, Georgia's \n \n condemnation of part of Land Lots 55 and 56 of the 7th District of Columbus, \n \n Muscogee County, Georgia, containing 99.92 acres of land on South Lumpkin Road \n \n a/k/a Tax Map 060-001-003 (see attached map).

Background
PrimeSouth Bank, formerly known as the Blackshear Bank, determined that the

best method to insure the City receive clear title was that the City utilize

Condemnation powers to acquire the above property. The Loan is in default and

PrimeSouth is reluctant to foreclose on the property because of the possibility

of some environmental hazards. The Landfill's operation began in the early

1970's and continued until June 1983. No formal closure activities were

conducted when the Landfill closed.
Analysis
The Council approved Resolution No. 472-04 allowing the application of a grant

from the Department of housing and Urban Development to acquire the property.

The grant was approved in the amount of $357,876. The City is now interested

in proceeding with the acquisition of the property. The bank will pay all

expenses associated with the filing of Condemnation.
Financial Considerations
The funding for the acquisition of the property will come from reimbursement

from HUD and will come from fund 0216. The fair market value of the property

has been established at $250,000.

Legal Considerations
That Council must approve the acquisition of properties.
Recommendations/ Actions
Approve the attached Resolution authorizing that the City Manager to acquire

the above referenced property.
