Recommendation
Authorize the execution of Certificate of Ownership and Agreement with the \n \n Georgia Department of Transportation for the 2004/2005 L.A.R.P. Program for 94 \n \n streets, totaling 18.125 =/- miles.

Background
The City submitted a list of 94 streets (see attached), that came from the

Pavement Management List, to Georgia Department of Transportation for

consideration of the Local Assistance Road Program. Sixty-four streets (64),

10.755 miles were chosen by the DOT. The DOT has agreed to also include the

remaining streets in their bid package, allowing the City to take advantage of

better prices from a larger quantity of material. The City will pay the DOT

for the patching L.A.R.P. and for patching and resurfacing for the PR

Projects. The information below shows funding received from the Georgia

Department of Transportation for the past six years:



1) FY 99 $608,200.00 FY 02 $359,606.00

2) FY 00 $613,248.00 FY 03 $689,304.00

3) FY 01 $397,023.00 FY 04 $412,209.00
Analysis
In order to receive the funding for this project, the City is responsible for

the following:



1) Doing advance patch work

2) Raising manhole covers and other street fixtures

3) Clearing ditches and drainage structures

4) Leveling of shoulders



Items 1&2 will be included in the DOT Bid Package. Items 3&4 will be done by

City forces.
Financial Considerations
The City's portion of patching on the LAU projects and patching and resurfacing

on the PR projects is estimated to be $800,000.00. The City will have to pay

the DOT their portion of the official bid, which is not expected to exceed said

amount, before the project will be awarded. Funding will be provided through

Paving Supported Capital Projects and CBA Lease Revenue Bonds, Series 2003A.

Legal Considerations
The City Attorney disagrees with the indemnification paragraph, but understands

that the DOT will not change the paragraph; therefore, to participate in this

program, the City has to accept it as does every government entity state-wide.
Recommendations/ Actions
Approve the resolution authorizing execution of the Certificate of Ownership

and Agreements and subsequent agreements necessary to implement these projects.
