Recommendation
Approval is requested to amend Resolution #289-03 authorizing to donate land to \n \n the Federal Government for Force Protection Security measures to authorizing an \n \n easement only to the Federal Government for 1.12 acres (10 ft. wide x 5280 ft. \n \n in length) around the Fort Benning installation (see attached letters and \n \n maps).

Background
Resolution #289-03 granted the donation of 1.12 acres of land to the Federal

Government, the Government does not wish to own the property. The Federal

Government desires the City to retain ownership of the property currently

consisting of 1.12 acres (10 feet wide X 5280 feet in length). The Federal

Government would have an easement to construct a fence enabling the Force

Protection Security to access control points in and around the Fort Benning

military installation.
Analysis
The easement would be granted with conditions as provided on the attached

letters.
Financial Considerations
The Federal Government will bear all cost associated with the construction and

continued maintenance of said fence.

Legal Considerations
Council must approve the corrected Resolution granting an easement on City

property to the Federal Government.
Recommendations/ Actions
Approve the attached amended Resolution for an easement to the 1.12 acre of

land to the Federal Government for a right-of-entry easement on City property.
