Approval is requested to declare a detention pond located at Fountain Court off \n \n Williams Road a/k/a 191-011-080 (see attachment A) as surplus and authorizing \n \n the City to transfer same to the original owners, Flat Rock Development, LLC \n \n and the acceptance of the detention pond at Doubletree Subdivision at the end \n \n of Fountain Court south of and near the City owned Fountain Court Detention \n \n Pond (see attachment B). This detention pond is owned by Dykes Development \n \n Company in Columbus, Muscogee County, Georgia.

Background
-
The City owns Fountain Court Detention Pond, it is approximately 3/4 of an acre
and was installed on a 12 acre commercial site located at Fountain Court, off
Williams Road. The pond was sized for the entire development and accepted and
deeded to the City as a "Commercial" detention facility in 1997. A developer
built a 250 +/- apartment complex at the end of Fountain Court. An old
lake-bed was used as the detention pond for the Doubletree Subdivision and
enlarged to include the Grand Reserve Apartment Community. This is the
previously described detention pond owned by Dykes Development Company.

Analysis

The City will deed the Fountain Court Detention Pond to Flat Rock Development ,
LLC, this will allow the site to be squared off and gain the area necessary for
development to allow the property to be placed back on the tax digest. Dykes
Development Company will deed to the City the Doubletree detention pond.
Public Services and Engineering have inspected the Doubletree Detention pond
and the following needs were addressed in order for the City to accept the
detention pond.
1. All trees on both sides of the dam were removed. The failure in the dam
was repaired down to the outlet pipe.
2. The outlet pipe through the dam was be repaired. Several failed joints
were repaired.
3. The 3 clumps of trees immediately around and in front of the metering
device in the pond were cut down flush with the ground.
4. The area around the outlet pipe of the existing outlet structure on the
pond on Fountain Court, was cleaned, including removal of trees and stumps, for
a distance 56' downstream on both sides of the pond. Riprap was placed or
repaired if necessary. The existing pipe has adequate capacity and is left in
place, the trees in the same area mentioned above was cut down flush with the
ground with the exception of the trees around the perimeter to leave a buffer.

Financial Considerations

The property will be transferred by Quit Claim Deed from the City to Flat Rock
Development, LLC and by Warranty Deed from Dykes Development Company to the
City.

Council must declare the property as surplus and approve the transfer and
acceptance of property.

Approve the attached Resolution declaring the property as surplus and
authorizing the City Manager to transfer the detention pond located at Fountain
Court a/k/a Tax Map 191-011-080 to Flat Rock Development, LLC and accept the
detention pond at Double Tree Subdivision at the end of Fountain Court from
Dykes Development Company.
