Approve the attached Resolution declaring property be acquired by the City, and \n \n condemned to clear title and authorize the City Manager to dispose of said \n \n property as surplus, identified as Tax Map Parcel 064-032-006 a/k/a 912 \n \n Benning Drive, Columbus, Muscogee County, Georgia, (see attached map).

Background
-
Columbus Housing Initiative, Inc. (CHI) on behave of South Columbus Community
Development, Inc. (SC CD) is requesting that the City utilize it's power of
Eminent Domain to clear the title of the above property. The property was
purchased on May 14, 2002 by SC CD and was determined that the title was not
clear. Numerous attempts have been made to clear the title by utilizing
alternative means but none have been successful. Condemnation is the only
viable option and necessary to clear the title. The request to proceed through
eminent domain will allow the property to be developed and return to the tax
rolls.

Analysis

The assistances of the City in proceeding to clear title through eminent domain
will help rehabilitate the subject property and allow qualified low-income
buyers.

Financial Considerations

All costs resulting from the process of eminent domain will be paid from the
HOME funds designated for SC CD with all work under the guidance and direction
of CHI.

Legal Considerations

Council must approve the transfer of real estate and newspaper notices shall
be published in accordance with Columbus Charter Section 7-501.
