Background

Mr. John Fiske is requesting that the City execute a Quit Claim Deed for all

rights, title and interest the City may have in a portion of an existing 10

foot drainage and utility easement located at 3951 Biltmore Drive on the plat

for Lot 2, Block "C", Section 4, Biltmore Forest, located in Columbus, Muscogee

County, Georgia.

Analysis

The existing drainage and utility easement is no longer in use and has been

abandoned by all parties concerned. The Engineering Department has examined

the property and has no objection to abandoning the easement. Written

confirmation has been received from Columbus Water Works, BellSouth, Georgia

Power Company, United Cities Gas Company and Mediacom.

A RESOLUTION

A RESOLUTION AUTHORIZING THE ABANDONMENT OF AN EXISTING TEN FOOT DRAINAGE AND

UTILITY EASEMENT AS SHOWN LOCATED AT 3951 BILTMORE DRIVE ON THE PLAT ENTITLED

LOT 2, BLOCK "C", SECTION 4, BILTMORE FOREST TO JOHN FISKE.

WHEREAS, the existing ten foot drainage and utility easement is no

longer in use and has been formally abandoned by all parties concerned; and,

WHEREAS, Columbus, Georgia, has no other use for the aforementioned

portion of the drainage and utility easement.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS

FOLLOWS:

That, certain drainage and utility easement as shown at 3951 Biltmore

Drive on the plat for Lot 2, Block "C", Section 4, Biltmore Forest dated July

5th, 1976 and located in Columbus, Muscogee County, Georgia be relinquished to

the above property owners.

Introduced at a regular meeting of the Council of Columbus, Georgia, held

the 8th day of October, 2002, and adopted at said meeting by the affirmative

vote of _____ members of said Council.
