Amend the General Government and Public Safety Pension Plans in accordance with the Economic Growth and Tax Relief Reconciliation Act of 2001 "EGTRRA".

Recommendation

Approve pension ordinance that admends both the General Government and Public \n \n Safety Pension Plans to provide certain provisions of the Economic Growth and \n \n Tax Relief Reconciliation Act of 2001 ("EGTRRA") in accordance with section \n \n 401(a)(17)(B), 415(B) and 401(a)(31) of the Internal Revenue Code.

Background

The amendment is intended as good faith compliance with the requirements of

"EGTRRA" and is to be construed in accordance with "EGTRRA" and guidance issued

thereunder. see copy of appendix A.

There is no current budgetary or financial impact other than compliance of the

Code.

The City Attorney has reviewed a copy of the amendment and there are no issues
