Background
The Georgia Department of Transportation (DOT) has submitted a Contract for

Acquisition of Right-of-Way for the construction of the widening of St. Mary's

Road from Buena Vista Road to Robin Lane. The project is included in the

Transportation Improvement Program and the City has previously entered into a

Local Government Agreement with DOT relative to this project.
Analysis
The City of Columbus, Georgia entered into a Local Government Project Agreement

to widen St. Mary's Road, approved by Council dated November 19, 1991 (Res#

579-91) whereas, the DOT will design the project, the City agreed to acquire

right-of-way and relocate utilities and the DOT will build the project. Design

has been done and the City is in possession of certified right of way plans for

72 parcels. After reviewing the preliminary plans, it appears that four (4)

businesses and six (6) homes will be involved in total acquisition and

re-location. The City has made early acquisition on four (4) houses in the

past few years. The remainder consists of strip takes, cost to cures and

damages.

The City Attorney does not agree with the disclaimer in this agreement.
Recommendations/ Actions
Approval is requested for Acquisition of Right-of-Way related to Project No.

STP-8038(7) Muscogee County be entered into and the Mayor is hereby authorized

to execute the same for and in behalf of the City and that further

authorization is given to the contract for professional services, i.e. real

estate appraisers, legal counsel, etc. upon compliance with Procurement

Ordinance and subsequent agreements to implement the project with Georgia DOT

for Road improvement of said project.
