Approval is requested to execute a "Right-Of-Entry For Construction" to Fort \n \n Benning, Georgia for a 40' temporary work area easement for the construction of \n \n a Cantonment Fence at Fort Benning, Georgia.

Background
Resolution 289-03 authorized the donation of City property consisting of 1.12

Acres (10 ft. Wide x 5280 ft. in length) around the Fort Benning installation

to the Federal Government. Resolution 505-03 amended Resolution 289-03 per

request of Department of the Army for the City to donate an easement and retain

ownership to said property. It was agreed the Federal Government would bear

all cost associated with the construction and maintenance of the fence. The

Department of the Army has now requested that the City donate a 40' temporary

work area easement for the actual construction of the fence. The construction

area was not included in the original resolutions. It is estimated that this

easement will be required for a period of no longer than 12 months. The survey

defines the permanent easement as 0.95 acres and the temporary work area

easement as 3.81 acres (see survey attached).
Analysis
The 40' easement would be granted with conditions as provided on the attached

letter.
Financial Considerations
The Federal Government will bear all cost associated with the construction and

continued maintenance of said fence.

Legal Considerations
Council must approve the Resolution granting a 40' temporary area construction

easement on City property to the Federal Government.
Recommendations/ Actions
Approve the attached Resolution granting the federal government a temporary

40' work area easement consisting of 3.81 +/- acres.
