Recommendation
Approval is requested for the Acquisition of Parcel 37 (thirty-seven) on the \n \n above referenced project 0.031 acres (1,359.65 square feet), of land for right \n \n of way for County Road and/or Municipal Street purposes, and authorizing the \n \n filing of said lands under the authority of the official code of Georgia \n \n annotated, Section 32-3-1 et. seq for the St. Mary's Road Widening Project.

Background
The City of Columbus, Georgia is responsible for the acquisition of Right of

Way for the St. Mary's Road Widening Project by a Local Government Project

Agreement signed with the Georgia Department of Transportation. The time to

certify Right of Way is July 2005. To meet the deadline we will have to

proceed with the Declaration of Taking on this parcel. The City has negotiated

with the property owner in good faith and have not been able to reach a fair

and amenable agreement with the property owner.
Analysis
To keep the project on schedule, it is necessary to proceed with a Condemnation

and pay the money into Court, thereby allowing the City to take possession of

needed property owner and proceed with the project.
Financial Considerations
This project is funded by the CIP Funds.

The City Attorney agrees to this action.
Recommendations/ Actions
Authorizing the City Manager to order the Acquisition of said lands for County

Road and/or Municipal Street purpose, and authorizing the filing of a

Deceleration of Taking by the City Attorney or his representatives for the

acquisition of said lands of 0.031 acres (1,359.65 square feet) under the

authority of the official code of Georgia annotated, Section 32-3-1 et-seq.
