Background

On July 2, 2002, a resolution was approved by Columbus Council authorizing the

acquisition of 90+/- acres at Cusseta Road for the Georgia Greenspace Program.

After submittal of the warranty deed to the Georgia Department of Natural

Resources, Columbus greenspace coordinators were informed that the warranty

deed did not comply with the conditions of the Georgia Greenspace Program Grant

Award Agreement. In accordance with the Georgia Greenspace Program Grant Award

Agreement, the following statements must be conveyed on a property or warranty

deed when purchasing an interest in land with greenspace grant funds: 1)

Greenspace Grant funds were used to purchase the real property interest; 2) The

State of Georgia is a third-party beneficiary under the Georgia Greenspace

Grant Award Agreement; and 3) If the greenspace property is used for anything

other than greenspace purposes, the State of Georgia has a right to require

performance of the Agreement and request that the property be returned to its

original use as agreed between the parties.

Analysis

It was recommended that a restrictive warranty deed for the greenspace property

be drawn up for the City of Columbus to itself. The above described warranty

deed properly conveys all of the statements necessary for this property to

fully comply with the Georgia Greenspace Program regulation.
