Condemnation of Property (# 2) on Williams/Whitesville Road Project

Recommendation

Approval is requested for the acquisition of Parcel 2 (two) on the above \n \n mentioned project, containing 0.013 acres (565.32 sq. ft.) of land for right of \n \n way for County Road and/or Municipal Street purpose, and authorizing the filing \n \n of a Declaration of Taking by the City Attorney or his representatives for the \n \n acquisition of said lands under the authority of the official code of Georgia \n \n annotated, Section 32-3-1 et.seq for the Williams/Whitesville Road Project.

Background

The parcel has to be condemned for Title. Releases have not been received in a

timely manner, after several attempts to do so.

Analysis

To keep the project on schedule it is necessary to proceed to condemn for Title

and pay the money into Court, thereby allowing the City to proceed with the

project and meet its deadlines.

Financial Considerations

This project is paid by the DOT )$250,000.00). The City will pay the balance

of the Bid amount to be paid out of the Paving Supported Capital Project Fund

and CBA Lease Revenue Bonds.

The City Attorney agrees to this action.

Recommendations/ Actions

Authorizing the City Manager to order the Acquisition of said lands for County

Road and/or Municipal Street purpose, and authorizing the filing of a

Declaration of Taking by the City Attorney or his representatives for the

acquisition of said lands under the authority of the official code of Georgia

annotated, Section 32-3-1 et-seq.
