Background

The Woodruff Family owns The Lakes Apartments located at 4343 Warm Springs
Road. The development of Phase Four, The Lakes Apartment, creates a land locked
parcel without lot frontage to a public street. The financial lender that
provides the loan for this development requires that each phase of the
apartments be treated as a separate parcel with a separate single purpose
entity, set up for the Woodruff Family. (see attached letter dated August 23,
2004)

The Engineering Department reviewed the request and recommends approval of the
variance based on the concept of being one part of the existing Lakes Apartment
Complex.
