Background
-
The Federal Commissions Commission (FCC) mandated that all radio licensees
(City) in the 800 Megahertz frequency band to comply with the 2004 FCC Order
#04-168 and 04-294 to accommodate frequency rebanding with Sprint Nextel nation
wide. Council has already approved by Resolution #25-07 for the planning phase
of this work. The requested resolution is for the implementation phase for
which Motorola, Inc., will perform the changing/programming of transmission
equipment and reprogramming of all radios on our 800 Mhz Radio System.

Analysis
-
The City's Frequency Reconfiguration Agreement (FRA) with Sprint Nextel will
include the work performed by Motorola, Inc., for which Sprint Nextel, not the
City, will be responsible for paying Motorola, Inc. The City will be
responsible for verifying to the FCC the work performed by Motorola, Inc., we
will then authorize Sprint Nextel to make payments. Motorola's proposal is for
$1,339,922 for performing all of their work for the City. Since this is an
estimated cost, it is our recommendation that we include a 10% contingency.
Any cost over the proposed amount will have to be approved by the FCC's
Transition Administrator before any other Sprint Nextel funds are expended.

Financial Considerations

All costs incurred by the FCC rebanding and reprogramming are the
responsibility of Sprint Nextel and not the City. Sprint Nextel has to insure
that the City has the same radio and radio system communications as it had
before the frequency swapping occurs.

Approve the attached Resolution authorizing the City Manager to execute a
Reconfiguration Proposal agreement with Motorola, Inc., our 800 Mhz Radio
System manufacturer, to implement the FCC Rebanding order that consist of
reconfiguring transmission equipment and reprogramming the City's radios with a
10% contingency.

A RESOLUTION AUTHORIZING TO EXECUTE A FREQUENCY RECONFIGURATION IMPLEMENTATION
AGREEMENT WITH MOTOROLA COMMUNICATIONS AND ELECTRONICS, INC., TO IMPLEMENT ALL
CHANGES AND REPROGRAMMING OF THE CITY'S 800 MHZ TRANSMISSION SYSTEM; REPLACE
AND/OR REPROGRAM ALL RADIOS WITH ALL COSTS TO ACCOMPLISH SAID WORK TO BE PAID
BY SPRINT NEXTEL, INC., AS REQUIRED BY THE FEDERAL COMMUNICATIONS COMMISSION.
WHEREAS, Motorola Communications and Electronics, Inc., is the manufacturer of
the City's 800 Mhz Radio Communication System and provides highly technical
maintenance and repair of the transmission system through annual contracts with
proposed work not being part of said contract; and,
WHEREAS, the Federal Communications Commission mandated through Orders #04-168
and #04-294 that Sprint Nextel exchange radio frequencies with public safety
radio systems nationally to eliminate radio signal interference; and,
WHEREAS, the City is required to enter into a Frequency Reconfiguration
Agreement with Sprint Nextel in which Motorola Communications and Electronics,
Inc., will perform certain implementation services for the City and be paid by
Sprint Nextel directly to Motorola Communications and Electronics, Inc., in an
amount estimated to be $1,339,922 and,
WHEREAS, the Engineering Department who manages the 800 Mhz Radio System
recommends approval of said agreement with a provision for a 10% contingency.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY
RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to execute a Frequency
Reconfiguration Implementation Agreement with Motorola Communications and
Electronics, Inc., for implementing all changes and reprogramming of the City's
800 Mhz transmission System, replace and/or reprogram all radios with all costs
to accomplish said work to be paid by Sprint Nextel, Inc., as required by the
Federal Communications Commission.
