Background
Georgia Department of Transportation quitclaimed a portion of the Welcome

Center's Drive Way and sufficient Right-of-Way to construct Williams Court as

part of the Williams Road Widening Project. New Right-of-Way was needed to

provide commercial and Apartment traffic access to Williams Road via the

traffic signal. Williams Court Cul-de-sac portion of street has been improved

and has met the required specifications for acceptance by the City.
Analysis
Deeds have been conveyed to the City conveying Parcel Welcome Center Road, PMF

#2364, that portion of Williams Way and Parcel 9 Right-of-Way, PMF# 2245, that

portion of Williams Court . A description of said properties attached to

quitclaim deeds and noted as Exhibit B. Parcel Welcome Center Road, PMF #2364

recorded in Deed Bk 8848 PG 60-62 filed and recorded March 15, 2007, Parcel 9

Right-of-Way, PMF# 2245, that portion of Williams Court recorded in Deed Bk

9168 PG 67-69 filed and recorded November 14, 2007 in the Office of the Clerk

of Superior Court of Muscogee, County, Georgia.



Deeds have been conveyed to the City conveying that portion of Williams Court

also know as the Cul-de-sac. A description of the property is as follows: All

that tract or parcel of land situate, lying and being in Columbus, Muscogee

County, Georgia, and being shown and designated as "0.160 Acres, 6964 Sq. Ft."

and All those tracts or parcels of land situate, lying and being in Columbus,

Muscogee County, Georgia, and being shown and designated as "0.001 Acres, 34

Sq. Ft." and "0.031 Acres, 1354 Sq. Ft." and "0.031 Acres, 1354 Sq. Ft." on

that certain map or plat thereof entitled "Replat of a Portion of Tracts 200

and 300, Part of Land Lot 273, 19th District, Columbus, Muscogee County,

Georgia," prepared by Becker Survey Company, dated April 28, 2008 and recorded

in Plat Book 161, page 265 in the Office of the Clerk of the Superior Court of

Muscogee County, Georgia, to which map or plat reference is hereby made for a

more particular description of the tracts conveyed hereby.
Financial Considerations
Parcel Welcome Center Road, PMF #2364, that portion of Williams Way and Parcel

9 Right-of-Way, PMF# 2245 and that portion of Williams Court were constructed

with funds from the Williams Road Widening Project. Georgia Department of

Transportation (GA DOT) retains a reversionary right to the above mentioned

property. In the event said property should no longer be needed for public

transportation purposes, The City acknowledges that title to said property will

be returned to GA DOT at no cost to them, free and clear of any and all liens

or encumbrances, as noted in Quitclaim Deed.



No City funds are involved until maintenance is assumed after the two-year

warranty on Part of lot 273, 19th District also known as Williams Court

Cul-de-sac.

Legal Considerations
In order to clarify designation of that portion of Williams Way and that

portion of Williams Court, as a public street, a resolution approved by Council

is needed. In accordance with Section 18-3 of the Columbus Code, all dedicated

right-of-way must be accepted by Council.
Recommendations/ Actions
Approve the Resolution designating Parcel Welcome Center Road, PMF #2364, that

portion of Williams Way and Parcel 9 Right-of-Way, PMF# 2245, that portion of

Williams Court as public streets. Approve the Resolution accepting deeds to

Part of lot 273, 19th District also known as Williams Court Cul-de-sac









A RESOLUTION



NO. _____

A RESOLUTION AUTHORIZING DESIGNATION OF THAT PORTION OF WILLIAMS WAY AND THAT

PORTION OF WILLIAMS COURT, LOCATED AT ENTRANCE OF THE WELCOME CENTER, AS A

PUBLIC STREET. AUTHORIZING THE ACCEPTANCE OF A DEED TO THAT PORTION OF WILLIAMS

COURT ALSO KNOWN AS THE CUL-DE-SAC, ON BEHALF OF COLUMBUS, GEORGIA.

WHEREAS, the City acquired property from Georgia Department of Transportation

(GA DOT) by quitclaim deeds in order to construct Williams Court as part of the

Williams Road Widening Project, a full description of property on said deeds;

and,

WHEREAS, GA DOT retains reversionary rights to the above mention properties. In

the event said properties should no longer be needed for public transportation

purposes, the City acknowledges that title to said properties will be returned

to GA DOT at no cost to them, free and clear of any and all liens or

encumbrances, as noted in quitclaim deeds.

WHEREAS, Columbus, Georgia has been submitted a deed conveying that portion of

Williams Court also know as the Cul-de-sac, a full description of property on

said deeds; and,

WHEREAS, that portion of Williams Way and that portion of Williams Court has

been improved under City contract and meets the required specifications; and,

WHEREAS, that portion of Williams Court also know as the Cul-de-sac has been

improved and meets the required specifications for acceptance by the City; and,

WHEREAS, the Engineering Department has inspected the streets and recommends

designation of that portion of Williams Way and that portion of Williams Court

and recommends acceptance of that portion of Williams Court also know as the

Cul-de-sac.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to designate that portion of

Williams Way and that portion of Williams Court as Public Streets. That certain

deeds dated November 25, 2008, conveying to Columbus, Georgia, that portion of

Williams Court also know as the Cul-de-sac be and the same is hereby accepted.

The Clerk of Council is hereby authorized to have said deeds recorded in the

Deed Records in the Office of the Clerk of Superior Court of Muscogee County,

Georgia. A copy of the deeds are hereto attached and by this reference made a

part of this resolution.
