Recommendation
Approval is requested to enter into a Memorandum of Understanding (MOU) with \n \n Historic Linwood Foundation, Inc., defining the responsibilities of the City \n \n and the Historic Linwood Foundation in the management of the Chapel.

Background
Pursuant to Resolution No. 428-05, the Linwood Cemetery Foundation, Inc., has

successfully moved a chapel to the Linwood Cemetery site (close to 10th

Avenue). The Historic Linwood Foundation now wishes to enter into a MOU with

the City (see attached).
Analysis
This property is owned by the City. The Foundation will be responsible for

fund-raising. The City will maintain its authority over the cemetery and

provide maintenance and security of the cemetery in a manner consistent with

the maintenance and security provided to other cemeteries under the control of

the City. The property cannot be used for any other purpose other than a

cemetery and associated facilities.

Financial Considerations
The foundation will pay all associated cost of upkeep and making any

improvements to the facility. Additionally, the foundation agrees there

will be no cost to the city associated with operating the chapel.

Legal Considerations
Council is required to authorize the City Manager to enter into Memorandum of

Understanding.

Request approval of a Resolution to enter into Memorandum of Understanding

with Historic Linwood Foundation, Inc.
