Recommendation
Approval is requested to execute a City Right of Way Agreement with the Georgia \n \n Department of Transportation (DOT) for a County Contract to construct a new \n \n road for development off of Chattsworth Road in support of an Economic \n \n Development Project.

Background
The Georgia DOT will assist the City of Columbus, Georgia in a County Contract

to construct a new road (0.18 mi) from Chattsworth Road to Dead End, Project

No. PRC10-S009(796).
Analysis
The City has requested State Aid from the Georgia DOT in a County Contract for

the project referenced above. To participate on the project the City is asked

to execute the attached agreement.
Financial Considerations
The Georgia DOT has agreed to pay an estimated amount of $125,250.00. The City

will pay the balance of the bid and will be reimbursed by Columbus Baseline

Development, LLC, a North Carolina limited liability company("Baseline").

Legal Considerations
The City Attorney disagrees with the indemnification paragraph, but understands

the Georgia DOT will not change the paragraph; therefore, to participate in

this program, the City has to accept it as does every government entity,

state-wide.
Recommendations/ Actions
Approve the resolution authorizing the Right of Way Agreement and subsequent

agreements necessary to implement this project.
