Recommendation
Approval is requested for theacceptance of that part of Weracoba Creek, Its \n \n banks and adjoining property lying immediately to the north of Lakebottom Park \n \n bordered on the south by Garrard Street, on the east by Cherokee Avenue, on the \n \n west by lands owned by Columbus, Georgia and extending north approximately 440 \n \n feet identified as Tax Map 185 004 008 and 009, to Columbus, Muscogee County, \n \n Georgia.

Background
Frank G. Lumpkin, III and Julia Willcox Lumpkin have offered to deed the above

described property to Columbus, Georgia at no cost to the City. This property

includes the land over which the Lumpkin's have given Columbus Water Works has

an easement allowing the Water Works to construct the water treatment facility

designed to improve the water quality in the downstream portion of Weracoba

Creek, reduce the creek's level of fecal coliform and change the creeks

impaired status by the Georgia EPD. Conveyance of this property to the City

will give the City the right to control and maintain this portion of Weracoba

Creek and adjacent property which will benefit all concerned. This property is

adjacent to property deeded the City by Flournoy Realty Company in 1924 for

park purposes. Each of the affected/involved City Departments recommend

acceptance of this property.
Analysis
Frank G. Lumpkin, III and Julia Willcox Lumpkin have offered to deed the above

described property to Columbus, Georgia at no cost to the City. Columbus Water

Works has an easement allowing the Water Works to construct the water treatment

facility designed to improve the water quality in the downstream portion of

Weracoba Creek.

Frank G. Lumpkin, III and Julia Willcox Lumpkin have offered to deed the above

described property to Columbus, Georgia at no cost to the City.

A RESOLUTION AUTHORIZING THE CONVEYANCE OF PART OF WERACOBA CREEK, ITS BANKS

AND ADJOINING PROPERTY LYING IMMEDIATELY TO THE NORTH OF LAKE BOTTOM PARK

BORDERED ON THE SOUTH BY GARRARD STREET, ON THE EAST BY CHEROKEE AVENUE, ON THE

WEST BY LANDS OWNED BY COLUMBUS, GEORGIA AND EXTENDING NORTH APPROXIMATELY 440

FEET ON TAX MAP 185 004 008 AND 009, TO COLUMBUS, MUSCOGEE COUNTY, GEORGIA.

WHEREAS, Frank G. Lumpkin, III and Julia Willcox Lumpkin have offered, at no

cost to Columbus, Georgia, to deed to the City that part of Weracoba Creek and

adjacent property lying immediately to the north of Lakebottom Park bordered on

the south by Garrard Street, on the east by Cherokee Avenue, on the west by

lands owned by Columbus, Georgia and extending north approximately 440 feet

identified as Tax Map 185 004 008 and 009.; and,

WHEREAS, Frank G. Lumpkin, III and Julia Willcox Lumpkin have heretofore

conveyed to Columbus Water Works an easement to allow the construction of the

water treatment Facility designed to improve the water quality in Weracoba

Creek, reduce the creek's level of fecal coliform and change the creeks

impaired status by the Georgia EPD; and,

WHEREAS, conveyance and acceptance of this property will allow Columbus,

Georgia to control and maintain the creek bed and the banks of this portion of

Weracoba Creek that lies immediately north of Lakebottom Park which will be

beneficial to the City and its citizens as it is adjacent to property

previously deeded to the City as a park.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY

RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to accept the conveyance of the

above described property and file deed to said property in the Office of the

Clerk of Superior Court of Muscogee County, Georgia.
