Background
Timothy Potter and Tamitha Moore, owners of 7108 Spring Walk Drive submitted a

request for a building permit to the Inspection and Codes Department in order

to have a swimming pool installed at which time he found out that the structure

and concrete pool surround would fall fifteen (15) feet onto a storm easement.

The Engineering Department was contacted and agrees to the abandonment of a

(15) foot section of the existing storm easement running northerly from the

south property line approximately 81.0 feet as shown on the highlighted plat.
Analysis
Timothy Potter and Tamitha Moore, owners of 7108 Spring Walk Drive submitted a

request for a building permit to the Inspection and Codes Department in order

to have a swimming pool installed at which time he found out that the structure

and concrete pool surround would fall fifteen (15) feet onto a storm easement.

After checking, the Engineering Department found no present or future use of

that portion of the existing storm easement and is in agreement that a fifteen

(15) foot wide section along the western side of the existing twenty-five (25)

foot storm easement running northerly from south property line approximately

81.0 feet can be abandon. The remainder of the storm easement of record located

on Lot 37, Block "A" Riegel Pointe, Phase One Subdivision remains in effect and

provides appropriate width as required, repealing any conflicting ordinances,

and for other purposes.

Authorizing the City Manager to execute a Quit Claim Deed to Timothy Potter and

Tamitha Moore for abandonment of a fifteen (15) foot wide section along the

western side of the existing twenty-five (25) foot storm easement of Lot 37,

Block "A" Riegel Pointe, Phase One Subdivision in order to construct a swimming

pool and concrete surround.
