Approval is requested to authorize a variance for the Wellington Pointe Third \n \n Addition Subdivision to City Code 7.10 of the Unified Development Ordinance \n \n (UDO) requiring the installation of sidewalks as part of all residential \n \n development.

Background
-
City Code 7.10 of the UDO requires installation of sidewalks for all
residential subdivision with the exception of streets that do not have curb and
gutter, large lot developments that have lots that are one acre or more and
have an average lot frontage of at least 200 ft., short cul-de-sac streets or
where a separate trail system is provided.

Analysis
-
The original subdivision has 59 lots with 50 of those being developed prior to
UDO and without sidewalks. The remaining lots meet the minimum requirement of
one-acre lot exemption but do not have the minimum frontage requirement of 200
linear feet. Approved site plans requires sidewalks on 4 lots only. These lots
are located in a cul-de-sac where there will be no through traffic. The
developer has requested a variance to the requirement for installation of
sidewalks since these sidewalks would have random start and stop points.

There are no current expenses to the City.

The City will be responsible for maintenance at the end of the two year
warranty period.

Variances to the City Codes involving public right of way require Council
approval.

Approve the resolution authorizing the variance to City Code 7.10 of the
Unified Development Ordinance (UDO) for the installation of sidewalks.
