Recommendation
Approval is requested to declare 7,500 square feet +/- property behind 4753 \n \n Gardiner Drive as surplus and transfer by Quit Claim said property to the owner \n \n of 4753 Gardiner Drive. (see attached map).

Background
The subject property is an over-grown ditch/creek owned by the City behind

Gardiner Drive . The owner of 4753 Gardiner Drive considers the property a

nuisance due to the snakes and rodents on the property.
Analysis
The owner will provide maintenance of over-grown weeds. The quit Claim Deed

will provide for restriction of cutting any trees within 25' of the top of the

bank of the creek. The owner agrees to pay for a survey of the property prior

to transfer.
Financial Considerations
The property is being transferred and quit Claimed pursuant to 7-501 of the

Columbus Charter because it is no longer needed by the consolidated

government. The property is also land locked and creating a nuisance to the

property owner at 4753 Gardiner Drive.

Legal Considerations
The trees cannot be cut within 25' of the top of the bank of the creek.

Council must approve the transfer of property.
Recommendations/ Actions
Approve the attached Resolution declaring the City property as surplus and

transferring the land to the owner of property at 4753 Gardiner Drive.
