Approval is requested to execute a Quit Claim Deed for the alley adjacent to \n \n Wynnton Hill Baptist Church, Inc. The alley 0.0972 acres +/- a distinct of \n \n 24.29' +/- x 174.79' +/- located at the rear and side of 2620 Buena Vista Road \n \n and 748 and 748A Lawyers Lane a/k/a Tax Maps 050 039 001, 009 and 010 to make \n \n an addition to their parking lot (see attached letter and map).

Background
The property owner is requesting that the City execute a Quit Claim Deed for

all rights, title and interest the City may have in the above described alley.

The Church future use includes an expansion of their parking lot. Both 748 and

748A Lawyers Lane have now been combined to make one property.
Analysis
The alley is located along the intersection of the existing northwestern right

of way line of Cusseta Road with the southwestern side of 20th Avenue on Tax

Map 050 in Columbus, Georgia. Written confirmation has been received from all

public utilities stating there are no active utilities located in this alley.

The Engineering, Public Services and other City Departments have examined the

alley and have no objections to the abandonment.

A RESOLUTION AUTHORIZING THE EXECUTION OF A QUIT CLAIM DEED TO WYNNTON HILL

BAPTIST CHURCH, INC., FOR THE ALLEY PORTION OF THE 0.0972 ACRES +/- LOCATED AT

THE REAR AND SIDE OF 2620 BUENA VISTA ROAD AND 748 AND 748A LAWYERS LANE A/K/A

TAX MAPS 050 039 001, 009 AND 010.

WHEREAS, there is a 0.0972 acres+/- alley located at the rear and side of 2620

Buena Vista Road and 748 and 748A Lawyers Lane with Wynnton Hill Baptist

Church, Inc.requesting the alley be abandonment, and;



WHEREAS, 748 and 748A Lawyers Lane has now been combined as one property, and;



WHEREAS, the City has no present or future use of said portions of the alley,

and;

WHEREAS, the Engineering, Public Services and other interested Departments have

reviewed the abandonment of the alley and approves same, and;



WHEREAS, the City has no present or future use of said portions of the

alley.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY

RESOLVES AS FOLLOWS:

. That the City Manager is hereby authorized to execute a Quit Claim Deed to

Wynnton Hill Baptist Church, Inc. for the 0.0972 +/- acres alley located at the

rear and side of 2620 Buena Vista Road and 748 and 748A Lawyers Lane a/k/a Tax

Maps 050 039 001, 009 and 010. The alley will make an addition to parking lot

portions of Wynnton Hill Baptist Church, Inc., which is hereby abandoned. A

copy of said Quit Claim Deed is also hereto attached and by reference made a

part of this Resolution.

QUIT CLAIM DEED





The State of Georgia, MUSCOGEE County:

KNOW ALL MEN BY THESE PRESENTS, That in consideration of the sum of one and

no/100 dollars to usin hand paid by Wynnton Hills Baptist Church, Inc. the

receipt whereof is hereby acknowledged, we do remise, release, quit claim and

convey to the said Wynnton Hills Baptist Church, Inc.all our right, title,

interest and claim, in or to the following described land, to-wit: ALLEY

ABANDONMENT

Date of: 29 JANUARY 2008

All that tract or portion of land lying and being in Land Lot 79 Coweta Reserve

Columbus Muscogee County Georgia, being more particularly described as follows:

From the Point of Beginning,

Commence at a point formed by the intersection of the southerly right-of-way

line of Buena Vista Road and the easterly right of way line of Lawyers Lane,

run thence in a southerly direction along said easterly right-of-way-of Lawyers

Lane south 58 degrees 13 minutes west 56.00 feet to a point, run thence along a

curve to the left said curve having a radius of 219.89 feet and a arc length of

196.58 feet, run thence along a chord south 32 degrees 37 minutes 54 seconds

west a distance of 190.10 feet to a point; run thence south 01 degrees 08

minutes 43 seconds east a distance of 178.85 feet to a point on the northerly

right-of-way of said alley said point being the point of beginning.

From said point of beginning run thence along said northerly right-of-way line

of said alley south 87 degrees 21 minutes 43 seconds east a distance of 174.79

feet to a point on the easterly right-of-way line of said alley. Run thence

along said easterly right-of-way line of said alley south 00 degrees 23 minutes

55 seconds east a distance of 24.27 feet to a point on the southerly

right-of-way line of said alley, run thence along said southerly right-of-way

line of said alley north 87 degrees 21 minutes 43 seconds west a distance of

174.47 feet to a point on the easterly right-of-way line of Lawyers Lane, run

thence along said right-of-way line of Lawyers Lane north 01 degrees 08 minutes

43 seconds west a distance of 24.29 feet to a point which is the point of

beginning.

Said alley contains 0.0972 acres more or less and is shown on a survey prepared

by Hobbs, Smith and Associates titled replat of part of Land Lots 78, 79, 90

and 91 Coweta Reserve, Columbus, Muscogee County, Georgia and Recorded in Plat

Book 161 Page 68 in the office of the Clerk of Superior Court Muscogee County,

Georgia



Also providing that all existing utility easements of record remain in effect

and providing appropriate width as required by the applicable utility companies

will be required for unknown utilities, repealing any confliction ordinances,

and for other purposes.
