Approval is requested to declare surplus and transfer, 2400 13th Street a/k/a \n \n Tax Map 185 051 005, with the land area of 8,411 square feet, on the corner of \n \n 13th Street and Stark Avenue to the adjacent two property owners (see attached \n \n maps).

Background
The property was acquired by the City for a future road widening project. The

City no longer needs the property for the road widening project. The adjacent

property owners requested that the City transfer the property to be used for

additional parking. The property consists of land area of 8,411 square feet,

located at 2400 13th Street a/k/a Tax Map 185 051 005 and will be transferred

by Quit Claim Deed.
Analysis
Owner (1) will receive 56' x 95.46' +/- and Owner (2) will receive 56' x

54.9'. The property which will contain a reversionary clause to return said

property back to the City should we need the property for future road

projects. It will also contain a restrictive clause that will not allow any

permanent structure to be built on the property. The transfer will be subject

to reservation of all existing utility easements of record, known and unknown.
Financial Considerations
The property will be Quit Claim to the adjacent property owners which will

return the property to the tax roll with Owner (1) will receive 56' x 95.46'

+/- and Owner (2) will receive 56' x 54.9'. The City will transfer the

property by Quit Claim Deed with the reversionary and restrictive clause to the

adjacent property owners at no cost.

Legal Considerations
Council is the approving authority to declare the property as surplus, the

transfer of said property and the execution of a Quit Claim Deed by the City

Manager.
Recommendations/ Actions
Approve the attached Resolution declare the above property as surplus and have

the City Manager transfer by Quit Claim Deed said property to the adjacent

owners.

A RESOLUTION AUTHORIZING THE PROPERTY LOCATED AT 2400 13TH STREET A/K/A TAX MAP

185 051 005 TO BE DECLARED SURPLUS AND THE CITY MANAGER TO EXECUTE A QUIT CLAIM

DEED TO THE ADJACENT PROPERTY OWNERS.

WHEREAS, the City property consist of 8,411 +/- square feet, on the corner of

13th Street and Stark Avenue adjacent to the property owners, and;

WHEREAS, the City of Columbus, Georgia no longer needs the property for the

road widening project, and;



WHEREAS, the transfer will be subject to reservation of all existing

utility easements of record, known and unknown, and;



WHEREAS, a reversionary and restrictive clause will be included to

return said property back to the City should the City need the property for

future roadway improvements and no permanent structures may be built on the

property, and;



WHEREAS, the adjacent property owners have agreed to accept the

property with the reversionary and restrictive clause, and;



WHEREAS, it has been determined that it is in the best interest of the

Consolidated Government of Columbus, Georgia to transfer this property to the

adjacent property owner.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY

RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to:



1. Declare the property located at 2400 13th Street a/k/a Tax Map 185 051 005

as surplus and transfer said property; and,

2. Execute a Quit Claim Deed to the adjacent property owners; and,

3. Include a reversionary and restrictive clause in the Quit Claim Deeds to

return said property to the City should the City need the property for future

roadway improvements and no permanent structures may be built on the property.

The transfer will be subject to reservation of all existing utility easements

of record, known and unknown.

4. Authorize the Community Reinvestment Department to file said Deeds with the

Clerk of Superior Court.
