Recommendation
Approval is requested to execute a City Right of Way Agreement between the \n \n Georgia Department of Transportation (DOT) and the City of Columbus for a \n \n County Contract to improve 0.58 miles of entrance of new Schomburg Road School.

Background
The DOT will assist the City of Columbus, Georgia in a County Contract in

improving 0.58 miles of entrance of new Schomburg School, Project No.

PRC10-S010-00(533) along Schomburg Road.
Analysis
The City has requested State Aid with the DOT in a County Contract for the

project mentioned above. To participate on the project the City is asked to

execute the attached agreement.
Financial Considerations
The DOT has agreed to pay an estimated amount of $500,000. The City will pay

the balance of the bid. The total bid is not expected to exceed $1,140,000

(leaving the City with estimated portion of $640,000.

Legal Considerations
The City Attorney disagrees with the indemnification paragraph, but understands

that the DOT will not change the paragraph; therefore, to participate in this

program, the City has to accept it as does every government entity, state-wide.
Recommendations/ Actions
Approve the resolution authorizing the City Right of Way Agreement and

subsequent agreements necessary to implement this project.
