Background
Mr. Buddy Nelms owns/operates a business known as the Loft located at 1032
Broadway. Mr. Nelms plans a building addition of a balcony to extend eight
feet into the street right-of-way. The balcony is designed to be counter
levered with no supports being installed within the sidewalk area.
Analysis
An architectural drawing is attached showing the proposed balcony. The City
has authorized permanent encroachments into the right-of-way in the past with
the condition that should the encroachment ever become a conflict with any
public improvements, the encroachment shall be removed at no cost to the City.
Financial Considerations
There are no financial costs to the City for said encroachment.

Council.

A RESOLUTION AUTHORIZING A PERMANENT ENCROACHMENT OF A LOFT BALCONY EIGHT FEET
INTO THE PUBLIC RIGHT-OF-WAY AT 1032 BROADWAY; SAID ENCROACHMENT APPROVED WITH
THE CONDITION THAT SHOULD THE BALCONY EVER BECOME A CONFLICT WITH ANY FUTURE
PUBLIC IMPROVEMENT, THE BALCONY SHALL BE REMOVED AT NO COST TO THE CITY.
WHEREAS, Mr. Buddy Helms desires to construct a building addition to the
existing building/business known as the Loft with the addition of a loft
balcony over the City sidewalk; and,
WHEREAS, the architectural design will eliminate any supports or obstructions
in the sidewalk; and,
WHEREAS, the Engineering and Inspections and Code departments have reviewed the
architectural drawing concurring with the requests for a permanent encroachment
into the Broadway right-of-way.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That a permanent encroachment of a loft balcony eight feet into the public
right-of-way at 1032 Broadway is hereby authorized; said encroachment approved
with the condition that should the balcony ever become a conflict with any
future public improvement, the balcony shall be removed at no cost to the
city.
