Background
The City is working on the Flood Abatement Project - 6th Avenue & Side Streets

System Phase II-V. The RAILROAD operates track within the city of Columbus

owned by the Georgia Department of Transportation (DOT). This agreement is

required as part of conditions to obtain a permit from DOT. Replacement of the

combined sewer system will cross beneath the tracks of RAILROAD and require

RAILROAD to remove and restore its tracks at certain locations to accommodate

the City project.
Analysis
The City has met with representatives from Georgia Southwestern Railroad, Inc.

An estimate has been provided of cost of materials, labor, and equipment,

$228,387.00 and Engineering Services, $43,960.00 for a total of $272,347.00.

Authorize the City Manager to execute an agreement with Georgia Southwestern

Railroad, Inc. (RAILROAD) for reimbursement of expenses incurred by the

RAILROAD to accommodate the replacement of their existing combined sewer system.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH GEORGIA

SOUTHWESTERN RAILROAD, INC., (RAILROAD) FOR REIMBURSEMENT OF EXPENSES INCURRED

BY THE RAILROAD TO ACCOMMODATE THE REPLACEMENT OF THE CITY'S EXISTING COMBINED

SEWER SYSTEM IN THE AMOUNT OF $272,347.00.

WHEREAS, the City proposes to replace their existing combined sewer system

located at a point beginning at the Chattahoochee River and lying generally in

a northward direction to 14th Street and lying primarily in the right of way of

6th Avenue as shown on Exhibit A of the agreement, and by this mention, made a

part of this resolution.

WHEREAS, the RAILROAD operates certain track within the City of Columbus owned

by the Georgia Department of Transportation (DOT), and the replacement of the

combined sewer system will cross beneath the tracks of RAILROAD and require

RAILROAD to remove and restore its track at certain locations and to oversee

borings and open cuts at certain locations to accommodate the City project.

WHEREAS, this agreement is required as part of the conditions to obtain a

permit from DOT.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY

RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to execute an agreement with

Georgia Southwestern Railroad, Inc., for reimbursement of materials, labor,

equipment and Engineering Services incurred to accommodate the replacement of

the City's existing combined sewer system, 6th Avenue & Side Streets System

Phase II-V, in the amount of $272,347.00 Funds to be paid from 2010A Bond 6th

Avenue Flood Abatement Project 0558-800-2170-81002-20100.
